The objective of this presentation is to assist practitioners in the understanding intricacies related to a city’s requirement that a developer acquire and develop off-site improvements related to a project. Topics include an overview of the Subdivision Map Act regarding off site public improvements (Gov. Code § 66462 et seq.), key considerations before conditioning a map approval to construct off-site improvements, significant topics that arise during negotiations between a city and developer of an offsite acquisition agreement (including issues related to litigation discretion, developer oversight and right to abandon the litigation, and methods of funding the litigation), and the relationship between the city and the developer during subsequent eminent domain litigation.
