And the Defense Wins

Daniel W. Maguire and Keiko J. Kojima secured a defense verdict for Paul Revere Life Insurance Company following a four day jury trial in San Diego federal court in January 2011. Plaintiff Weyman H. Cox asserted claims for breach of contract and bad faith challenging Paul Revere's determination that his total disability was due to sickness, rather than injury, thereby resulting in an 80% reduction in his monthly benefit. Cox sought accelerated contract benefits for life, emotional distress damages, attorneys' fees and punitive damages, but the jury returned a defense verdict after 4 hours of deliberation.
