Russell v. Massachusetts Mutual Life Insurance Co. (1985) 473 U.S. 134. 

Represented the defendant in this insurance disability benefits case  under the Employee Retirement and Income Security Act (ERISA).  The U.S. Supreme Court reversed the 9th Circuit, based on Mr. Frank’s briefing concerning implied private rights of action, establishing an important precedent limiting litigation and remedies arising out of benefits decisions by plan fiduciaries in self-funded benefits plans covered by ERISA.
