Brian P. Ross

Brian Ross is a senior associate in Burke’s Labor and Employment Practice Group.

Brian’s focus is on general litigation, writs of mandate, and general labor and employment legal issues, with focuses on the Meyers-Milias-Brown Act, the Public Safety Officers and Firefighters’ Procedural Bill of Rights Acts, and various pension laws affecting public employees. Brian has argued numerous cases through trial before the Los Angeles County Superior Court, obtaining victories for clients regarding uses of force, improper discipline, and the failure to pay backpay. He was also significantly involved in challenges to SB 1421, the new state law relating to the confidentiality of certain peace officer records.

Brian has appeared multiple times before the California Court of Appeal, arguing cases relating to the First Amendment rights of police officers in Facebook posts, defamation and libel arising from the distribution of an election flyer by a union, due process rights relating to telephonic testimony of witnesses, and the statute of limitations protecting peace officers. His advocacy on behalf of unions in the State of California has resulted in numerous published appellate decisions that have clarified existing law and expanded the ability of unions to seek relief in the courts. He has also represented peace officers in administrative and court proceedings related to discipline and in court proceedings relating to indemnification.

Brian received his Juris Doctorate in 2010 from UCLA School of Law with a specialization in Business Law and Policy. Following law school, he worked at the Los Angeles County Superior Court for two and a half years, serving as a research attorney for the Honorable Kevin Brazile and the Honorable Yvette Palazuelos.

A father of two young boys and a proud resident of Boyle Heights in East Los Angeles, Brian is one of the few to have the honorable distinction of being a two-time loser on Jeopardy! He is hoping that Jeopardy introduces a third-chance tournament so that he may continue his streak.
