Marina I. Garcia is a senior associate in the San Francisco office of Burke, Williams & Sorensen and a member of the firm’s Employment Law and Litigation practice group.
She counsels and defends public and private employers across the full spectrum of employment law, including matters involving discrimination, harassment, retaliation, wrongful termination, disability accommodations, and employee misclassification. Marina also represents clients in complex class actions and representative proceedings under California wage and hour laws and the Private Attorneys General Act (PAGA).
Marina has significant experience advocating before state and federal courts, arbitration panels, and administrative agencies such as the Division of Labor Standards Enforcement and the Department of Fair Employment and Housing.
Before joining Burke, Marina worked at a prominent international law firm, where her practice focused on employment litigation, including harassment, discrimination, retaliation, wrongful termination, wage and hour violations, and PAGA matters. She also advised employers on workforce reductions, group layoffs, business reorganizations, executive terminations, paid sick leave, accommodation requests, independent contractor classification, overtime exemptions under California and federal law, and meal and rest period compliance.
Earlier in her career, Marina defended municipalities and school districts at a public entity defense firm in high-profile employment litigation involving FEHA violations and civil rights actions under Title VII, Title IX, and 42 U.S.C. §§ 1981 and 1983.
She is skilled in all phases of civil litigation, from motion practice and oral argument to depositions, complex discovery, settlement negotiations, and trial preparation.
