Clearing the Air: What’s Happening with Cannabis in the Workplace Now and Where the Winds Might Blow

As society’s outlooks shift and legislators evaluate future lawful uses of cannabis, employers must navigate an ever-changing legal landscape. In this session you’ll learn about the current and anticipated future cannabis-related laws and their significance for the public agency workplace. You’ll learn about prior legislative efforts to alter the treatment of cannabis use for applicants and employees in California as well as current workplace cannabis laws in other states, and pending (and any recently adopted) legislation in California and Congress. You’ll learn about the current legal standards related to cannabis use and ADA/FEHA reasonable accommodation, and the factors that public agencies should weigh in assessing testing requirements for positions (safety-sensitive and not). And you’ll receive guidance on policy updates and implementation based on the latest research on testing and impairment, to ensure your agency’s testing policy meets constitutional constraints.
